AutoPay Terms — New 30-Day Enrollments

AutoPay is optional. Selecting it saves your payment method and enrollment for the phone number, refill amount, and processing fee shown at checkout. The displayed total is the amount per 30-day refill when automatic billing is available. Your purchase today is a separate, one-time refill.

Automatic billing is currently paused. Saving an enrollment does not start automatic charges or guarantee a refill on a particular date. Continue to refill manually while billing is paused. We will communicate the start date and billing terms before activating automatic renewals; no activation is promised by this enrollment.

You may cancel your saved enrollment at any time in your account or through the cancellation link in your enrollment email, without signing in. Cancellation stops future automatic renewals and does not undo refills already delivered. Fees and the refill total are disclosed before you consent; a changed amount or cadence requires updated consent.

Selecting “Enable Monthly AutoPay” at checkout requests a new 30-day enrollment. Existing enrollments keep their previously agreed cadence and dates; they are not converted by these terms. A 30-day interval is not a calendar month and does not guarantee uninterrupted carrier service.

1. Acceptance of Terms

By accessing or using MobiSend’s services, website, or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

MobiSend is a consumer bill-payment service for prepaid wireless. Through the Service, customers purchase prepaid airtime and plan credit that MobiSend, as merchant of record, delivers to the US phone number the customer designates; the carrier applies it to that line’s service. Payment is captured only after delivery is confirmed. International top-up features described on the Service are not yet available for purchase; these Terms will be updated before they launch.

3. User Accounts

To use certain features of our Service, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Payment Terms

By making a purchase through MobiSend, you agree that:

• All fees and charges are displayed before you confirm your transaction
• Transactions are processed in US dollars unless otherwise specified
• You are responsible for any applicable taxes
• Refunds are subject to our Refund Policy

5. Delayed Delivery and Cancellations

If a carrier does not confirm delivery of your refill promptly, your order enters a delivery queue instead of failing:

• While your refill is queued, your payment remains a temporary authorization only — you are not charged unless the refill is delivered.
• We keep watching for delivery for up to 4 hours, and you can opt in to email or text status updates from your confirmation page.
• You may cancel a queued refill at any time from your confirmation page or the link in our status messages — no account required. Canceling releases the hold on your card immediately.
• If delivery is not confirmed within 4 hours, the authorization is released automatically and you are never charged.
• If a refill is delivered after you cancel or after the hold is released, it is yours free of charge — we will not capture payment for it.

6. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Use stolen or fraudulent payment methods
• Resell our services without authorization
• Abuse promotional offers or referral programs

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBISEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
